Bryant® Refutes P&S Patent Infringement Lawsuit, Claims Patent Is Invalid

This is in response to Pass & Seymour/Legrand (P&S) allegations that the Bryant Electric’s Quick-Tech™ offering infringes on U.S. Patent No. 6,994,585. Bryant has conducted extensive research regarding the above referenced patent and Bryant believes that the patent is invalid and thus is not infringed. Bryant through its ultimate parent company Hubbell Incorporated has requested the U.S. Patent and Trademark Office to invalidate the claims in that patent, filing an official request on November 29, 2006.
At this time there is no confirmed date by the U.S. Patent and Trademark Office to render Hubbell’s request to invalidate U.S. Patent. No. 6,994,585. Such requests typically are not reviewed and resolved immediately, and it is possible a final decision may not be rendered for a period of several years.
Since Bryant (Hubbell) has filed a request to void the referenced patent, it is Bryant’s opinion that it is unlikely P&S will be granted an injunction to stop Bryant or its customers from marketing and selling the Quick-Tech offering. In the event the U.S. Patent Trademark Office does not void the patent, Bryant Electric will indemnify and hold harmless its direct and indirect customers. Hubbell believes based on previous legal experience that replacement of installed devices would be a rare occurrence.
